Terms of service
1. Who we are
Nyanyuka is a platform owned and operated by Nyanyuka Investments Limited ("Nyanyuka", "we", "us"), an investment advisory and technology company in Kenya, with offices at Victoria Plaza, 8th Floor, Westlands, Nairobi. These terms apply when you use the Nyanyuka app, our USSD service and nyanyuka.com (together, "the platform"). By creating an account you agree to them.
2. What Nyanyuka is
Nyanyuka is a platform that supports social savings. You can save on your own, toward goals and with your chama, invite the people you know, and, as your savings grow, invest with our guidance.
We are not a multi-level marketing company. You are rewarded only for friends you invite yourself, never for anyone they invite. We do not promise returns on savings.
3. Your account
- One account per person. Some services need your Kenyan national ID to be checked first.
- Give true details and keep them up to date.
- Keep your PIN secret. Anything done with your PIN is treated as done by you. If you think someone knows it, change it in the app and tell us at once.
- We will never ask for your PIN or your SMS code.
4. Joining and inviting
- You join with KES 1,500, shown before you pay. You start with KES 1,500 in your account.
- For every friend who joins with your number, you get KES 1,000 in your account, which you can withdraw.
- Inviting yourself, fake or duplicate accounts, or misleading people to get them to join are not allowed. Rewards gained this way are reversed and the accounts involved may be suspended.
5. Saving and withdrawing
- You add money to your account and withdraw it to your own registered phone number.
- The smallest amounts and any fee are shown in the app before you confirm. Today you can save from KES 10 and withdraw from KES 100.
- Money you put in a goal stays there until the date you chose.
6. Chamas and Biz Support
- A chama runs by its own rules, agreed by its members. Chama money is paid out only after the members vote for it.
- A member can ask their chama for Biz Support for their business. The other members vote; if they agree, the money is sent to the member, who returns it in the monthly instalments shown when asking. The chama processing fee is set by the chama and shown before the member asks.
- Chama officials are responsible for the information they enter for their group.
7. Investing
- We advise members on investments and choose the investments we consider most appropriate.
- You decide whether to place an order. When you do, we have the shares bought or sold on your behalf through our broker, together with other members' orders.
- The price, exchange rate and fees are shown before you confirm.
- Share prices go up and down. The value of an investment can fall as well as rise, and past results do not promise future ones.
- Investing opens once your savings reach the level shown in the app.
8. Fees
Every fee is shown in the app before you confirm. If a fee changes, we tell you in the app first, and the change never applies to anything you already confirmed.
9. Your data
We operate under the laws of Kenya and handle your personal data under the Data Protection Act, 2019. Our Privacy policy explains what we collect and why.
10. How we communicate
- We contact you by SMS and messages in the app about your account, payments and chama; by phone or WhatsApp only from 0724 035 047; and by email only from @nyanyuka.com addresses.
- You reach us by phone or WhatsApp on 0724 035 047; at help@nyanyuka.com for help, complaints and data requests; at member@nyanyuka.com for membership and chamas; in the app under Me → Help & support; or at our office, Victoria Plaza, 8th Floor, Westlands, Nairobi.
11. Closing or suspending an account
You can close your account in the app at any time once you have withdrawn what can be withdrawn. We may suspend an account for fraud, false details, misuse of the platform or when the law requires it, and we tell you why unless the law does not allow it.
12. Our responsibility
We run the platform with care. We are not responsible for delays caused by mobile networks, payment services or events outside our control. Nothing in these terms takes away rights you have under Kenyan law.
13. Complaints, law and changes
- If something goes wrong, see Complaints.
- These terms are governed by the laws of Kenya, and the courts of Kenya decide any dispute.
- If we change these terms, we update the date above and tell you in the app when the change matters to you.
